Full-Time College Student, Single, Independent, No Dependents, I receive $728 monthly in disability from the Federal Government in regards to a military service-connected injury, my income for 2007 was roughly $5k and I had $0 income in 2008. I want to know what my long and short term capital gains tax rates are and what happens in 2010 in regards to those rates?

I filed my federal return which is a little over $4600.00. I also have an active judgment under my name for federal student loans and they confirmed with me that $917.00 was going to be garnished from my tax refund. Due to the offset, is the IRS going to send my remaining refund via direct deposit as I requested or are they going to mail me a check?

I find this amazing that no one has really pointed this out that I know of about Obama’s tax plan. If he taxes Big Companies Like Walmart, Target, Oil Companies, etc.. they will have to raise prices on everything they sell to re-coop the taxes that Obama’s tax plan will do. I dont know about you but I like to pay less for gas and food items. That is just common sense. I don’t understand why people don’t get this. Also Obama says he wants to give 95% of Americans a Tax break but only 45% of Americans pay income taxes. How is that going to work. He is going to send them a Check I.E. Welfare Check. If someone keeps getting a check instead of working for thier money why would they ever want to get off welfare. Whatever happend to working hard for your money and supporting yourself?? Other countries do not even offer welfare you have to fend for yourself. If there was no welfare I am sure you would think twice about having a baby before you can offored it or not taking that job beause you just don’t want to work or whatever. Also Obama Wants to tax the capital gains and raise the taxes on them, but history shows than when you lower the capital gaines taxes the goverment takes in more revenue than when you raise the capital gaines taxes. And he was asked this in the Debate with Hillary and it was said to him “but when you lower the capital gains tax revenue goes up.” And he said ” Well it may or it may not” What the heck kinda answer is that. Also if you raise taxes on the wealthy it is not going to do any good. They have the money and the resorces to hire tax attorneys lawyers etc to legeal get around these taxes so what good does that do. Plus most of the rich own companies that employee you. Heck if I was rich I would do the same thing. Also history shows that when you have higher taxes it creats tax evasion and less productivity out of the us work force. I. E. people do not want to work as much because they are getting taxed to death. What does he not get here? I thought America was the country where you could become a Millionaire heck thats what America is all about. I guess Obama does not share that with us common folk. Obama is going to take YOUR HARD EARN MONEY AND SPREAD THE WEALTH AROUND. LET ME SAY THAT AGAIN OBAMA IS GOING TO TAKE YOUR HARD EARN MONEY AND DO WHATEVER HE WANTS TO DO WITH IT. PEOPLE WE NEED TO WAKE UP HERE!!!

American taxpayers could win the same get-out-of-jail-free pass, thanks to the ongoing legal saga of my friend and colleague, Rep. Charlie Rangel (D-Harlem), and new Treasury Secretary Timothy Geithner.
Chairman Rangel admitted on the floor of the House that he had for years failed to pay tax on rental income from his resort property in the Caribbean. He apologized for this “oversight” and agreed to pay his back taxes – but has paid no interest or penalties.
Secretary Geithner admitted in his Senate confirmation hearings he had for years failed to pay taxes on his income from the International Monetary Fund, even though the IMF sent him checks and instructions to pay those taxes. He also called this an “oversight,” has paid no penalties and faces no charges.
As a former practicing attorney and a Texas state judge for two decades, I can tell you: If that was you or me, we’d be socked with penalties and interest many times the amount of the original tax. In a case like Geithner’s, I suspect we’d likely face criminal charges as well.
But Rep. Rangel is the powerful Chairman of the House Ways and Means Committee, which oversees the IRS. And Geithner is secretary of the treasury – the boss of the IRS. Just like Bill Hobby, these two high-status fellows have received a little different treatment than the common taxpayer.
We either need to hold Chairman Rangel and Secretary Geithner fully accountable under the law – or we need a national “Hobby Rule” for taxpayers.
Last week, I introduced the Rangel Rule Act of 2009 (HR 735). Under this bill, any US citizen who owes back taxes can pay them and automatically waive all interest and penalties by writing “Rangel Rule” on their return.

In this case the same executor ok’d the previous estate and paid no taxes. The attorneys and Cpa firm also set up the first estate’s taxes and stated none were owed. When that person passed away the same people said no taxes were owed and when that person passed away they then stepped in and said taxes were owed and are blaming another cpa that had nothing to do with it.
now what they have done is state that the properties could not be dispersed due to the tax problem and allowed the properties to lay dormant and just paid the mortgages on them to the point where there is nothing left. The kicker is that the law firms and the cpa firm and executor have been handling both estates and knew about the tax problem as they set up the limited partnerships and have waited over three years and still not paid the taxes. Also the estate has a value of over $4 million and loaded with sell able timber and thus there was no reason to hold up the transfer of said properties. As they are only a small faction of the entire estate.
Is there anything legal that can be done. They also knew about the tax problem from the start and they are the ones that caused it. The IRS doesn’t seem interested and not sure who could help with it. I would think they are liable for damages. I was told that many estates are done this way by the attorneys and executors and that they come up with a “tax problem”, when they created it, but are able to milk the estate for tons of cash and in this case they have gotten aobut $250,000 for really nothing as they originally satated they found the tax problem in June, but according to court documents petitioned the court to reopen the first estate six months earlier in January.

From my understanding, they calculate your unemployment benefits from how much you made during certain quarters. And out of these paychecks that you have received, they have already taken federal taxes out, some of which go to the unemployment fund, which means that your unemployment money is your money anyway. So why do we get double taxed on it?
