If you have lived in 2 states but only earned income in 1, how do you allocate fed tax deductions between 2?
For example: If I lived in NY for 6 months and CA for 6 months. I earned 50k in NY and 0 in CA. On my state tax return I am asked what portion of my itemized deductions are for each state. Because I have no taxable income in CA can I allocate 100% of my deductions to NY and 0 to CA?
Can a patent attorney practice patent law in a state where they are not admitted to that state’s bar?
If you are admitted to the bar in one state (ie Wisconsin) and then move to another (ie Washington) and are allowed to practice patent law by the USPTO, are you required to be admitted to Washington’s bar prior to practicing patent law in Washington?

Why won’t the IRS, nor most C.P.A.’s show us the stautue where it’s states all workers must file a 1040 form?
Recently, Tom Cryer was recently found ‘not guilty’ by a jury for ‘failure to file’ a tax return. Mr. Cryer stopped filing yrs ago. The judge, the govt attorneys, and the jury all cannot find the statute.
Tom Cryer was also allowed enter the Constitution into evidence, and numerous ‘unanswered’ letters to the IRS.
Do any of u read about this in the mass media?

So answer me this Judy – kindly show me which statute in title 26 of the United States Code says all americans MUST file a tax return? And show me the statute of ‘who is liable’?

The govt could not show the statute of libility. That’s why Tom Cryer was found ‘not guilty’. That’s why Vernice Kuglin(a FedEX pilot) was also found ‘not guity’ for tax evasion for the vry same reason.

U must first have ‘taxable income’. There’s only two kinds of taxes. ‘Direct’ and ‘Indirect’. The 16th Amend confered no new power of taxes – so once again, there’s only two classes of taxes. DIRECT & INDIRECT.
Direct must b appt. Indirect equals excise tax which equals a ‘privilage’ tax – so says the crts. My exchange for labor (according to the US supr crt) is not a ‘privilage’.
And to the dude who says Tom Cryer ‘may’ lose his license to practice law. Who cares??? The crts have already stated, the practice of law is one of common Rights – AND NO LICENSE IS REQUIRED!!!

I heard that there is no law that states that we have to pay a federal income tax. Is this true?
I was watching a video that was talking about 9/11 and at one point there was a couple of former IRS workers that said that there is no law that says that we have to pay an income tax. They said that after asking about this there boss’ pretty much tried to “hush” them. After quitting the IRS they said they have not filed there taxes since. I am wanting to know the truth of this.

Where is the law that states that US citizens are required to pay a Federal Income Tax?
I am under the impression that no such law exists, but I would love for you to prove me wrong. So, I challenge you to find for me the written law stating that an American must pay a Federal Income Tax.
wow, I am getting a lot of responses. But I would like to make a few points:
in the IRS code 26 CFR Ch. 1 (4-1-03 Edition) it states that filing is “voluntary compliance”.
in the court case of the government vs Whitey Harrell, Mr Harrell was found innocent for refusing to file his 1040 since the jury found that they could identify no law requiring him to do so.
The Supreme Court ruled that the 16th Amendment did not create new taxing power. Therefore anyone who was untaxable before the 16th amendment remained so after it.
Please, refute these statements. Truly, I wan’t you to do it for me.

What the Supreme Court ruled, in Brushaber vs Union Pacific R.R. Co. and in Stanton vs Baltic Mining Co., is that since the provisions of Article I, requiring that direct taxes be apportioned, were not repealed, they are still in full force and effect. And, that since the language of the 16th Amendment specifies that the income tax is to be a tax without apportionment, then it cannot be a direct tax, because otherwise the Constitution would inherently contradict itself, which cannot be allowed to happen. Article I cannot prohibit direct taxation unless apportioned, while the 16th Amendment grants the power to lay direct taxes without apportionment, because then the Constitution would inherently contradict itself and could no longer serve as a valid foundation for our Law.

just one more thing to add… did you know that the federal income tax is used 100% to pay off the interest of the national debt and does not go to any services whatsoever. And also, did you know that the federal reserve is not a goverment body but a private corporate interest which has been given government authority to print the US dollar. Therefore the US government is indebted to a corporate entity and 100% of your income taxes go towards paying interest to that corporate body. So, basically your taxes are the privately owned federal reserve’s main source of profit.

income tax question for Australian who is resident in the united states?
I am applying for residency in the United States after marrying my American fiance. I have a small amount of (net) income from real estate that I own in Australia. I cannot yet work in the united states, but will get my work permit soon, then a green card a few months after that. Once I start work and file a return, do I pay tax in the States on my gross/net income from Australia? Should my husband and I file separate or joint returns?

That’s because cash-strapped states such as North Carolina, Alabama and Hawaii have been forced to slow down issuing income tax refunds to individuals and businesses because of a lack of funds in their budget.
Kansas has hinted that a delay might be possible, and processing paper refunds in Iowa has slowed because the state doesn’t haven’t enough employees to get them processed faster.
Another state, New York, is still considering whether they’ll follow the likes of Hawaii and delay refund payments.
“States typically do this when they are tight and they don’t have a budget in place,” said Karla Dennis, CEO of Cohesive, a nationwide tax preparation firm. Things are dire at many states: forty-one states are expected to have mid-year budget gaps totaling $37.7 billion, according to the Center on Budget and Policy Priorities.
Delaying the refund, Dennis says, “gives the state funds to work with in the interim to fill a gap in their revenues.”
Hawaii’s Department of Taxation announced last month that it will delay income tax refunds until July 1, when processing and payments will resume on a “first-in-first-out basis,” according to a news release. The state is delaying the funds to alleviate a $721 million revenue shortfall for the fiscal year ending June 30, 2010.
Under Hawaiian law, processing refunds must be done 90 days after the April 20 due day (or later if a return is filed after the due date).
After that, the actual payment must be made within 45 days or interest has to be paid on the refund. Most states have similar laws about when interest kicks in, but they differ from state to state, said Scott Clark a tax attorney and partner at Sonnenschein Nath & Rosenthal.

My mother-in-law sold her home in Venezuela, how do we get the money into the United States?
We are in the process of finding a tax attorney but we thought we would try here first. My wife’s mother is moving to the united states and will be a permanent resident (as soon as my wife becomes a US Citizen). How does she get the money from the sale of her home (in bolivares) to US dollars in the United States legally but with minimal tax liability? We estimate the value to be roughly $400k USD based on official exchange rates.
